Basic Terms & Conditions of the Auction

1. Date: Thursday, March 20th, 2025
2. Type: Live and Online Auction – No Reserve. Everything sells regardless of price.
3. Location: 1550 Lynn Brae Drive NE, Roanoke, VA 24012
4. Description: Business Liquidation: Valley Express Inc. Road Tractors, Vans, Trailers, Parts/Equipment.
5. Announcements: Announcements on day of sale take precedence over all prior releases, verbal and written, concerning this auction sale.
6. Auction Time: 10:00 AM ET. Registration will begin at 8:30 AM ET (Please bring your driver’s license for identification).
7. Online Auction Closes: Auction will start at 10:00 AM ET on Thursday, March 20, 2025 and close each item as it sells. A soft close will not apply, though the Auctioneer will be sensitive to Online Bidders.
8. Woltz & Associates, Inc. reserves the right to reject any bid at our sole discretion. Items may be added or deleted from sale. In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, Woltz & Associates, Inc., reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR WOLTZ & ASSOCIATES, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information deemed necessary by Auction Company.
9. Inspection Dates: All Personal Property will be available for inspection. A Representative will be on site Friday, March 7th, Saturdays, March 8th & 15th, 2025 from Noon – 4:00pm.
   Personal Property Location & Pickup: The Property is located at 1550 Lynn Brae Drive NE, Roanoke, VA 24012. Purchased property may be picked up on the day of sale or on March 21 – 23, 2025, from 9AM to 4PM.
10. Buyer Premium: A 10% Buyer’s Premium will be added to the high bid amount to determine the full purchase amount. For example, if your high bid is $100.00, your total purchase amount will be $110.00.
11. Payment: The online buyer’s credit card (cc used for registration for online bidders) will be charged immediately following the close of the auction. We accept Visa, MasterCard, American Express, and Discover for online bids. Online Buyers and Buyers paying with credit card will be charged a convenience fee of 3.5% of the purchase price. You will be emailed a receipt to the email address you provided during registration, if you bid online. Cash, personal check with bank letter, or cashier’s check are acceptable for live bids. Payment for purchases for any vehicles, trailers or equipment must be verified prior to titling.
12. Sales Tax: Not applicable, this is a business liquidation.
13. Credit Card Disclosure: To verify valid credit card information has been provided, your card will be temporarily charged $1.00. The charge will be reversed once the processor has found the card to be valid.
14. Disclaimer: Woltz & Associates, Inc. does not guarantee the authenticity of the listed items. Buyer shall be responsible for determining condition and authenticity of each item. All items are sold “AS IS” with all faults. Woltz & Associates is making every effort to secure titles for vehicles and trailers. Title status is updated as titles are obtained, so please check website regularly. Any vehicles and/or trailers that have no titles on sale day will be announced and sold without a title.
15. Photographs and descriptions of the items are to aid bidders in the bidding process. We make every effort to ensure that the items are photographed and described as accurately as possible. Terms and Conditions are subject to change. Please see woltz.com for updated information.
16. All Sales are Final: ALL SALES ARE FINAL WITH NO REFUNDS FOR ANY REASON. All items sold “AS IS” with no warranty. There shall be no guarantees or warranties, expressed or implied, statutory or otherwise, as to the merchantability or fitness for any particular purpose of any items offered in this sale. It is the Bidder’s responsibility to determine condition, age, genuineness, value, or any other determinative factor. Woltz & Associates, Inc. may attempt to describe the personal property in advertising and on the internet but makes no representations.
17. Shipping Instructions: THERE IS NO SHIPPING FOR THIS AUCTION. Buyer is responsible for all shipping logistics and costs. Buyers are responsible for bringing any equipment needed to pick up purchased items.
18. Removal of Personal Property: Paid receipt must be shown at time of pickup. BE SURE TO BRING YOUR PAID RECEIPT. Personal property becomes the responsibility of the buyer at the time of the sale. Neither the Auction Company nor the Seller provides equipment or labor to remove items purchased. Personal property pickup will be at the property, 1550 Lynn Brae Drive NE, Roanoke, VA 24012, and may be picked up on the day of sale or March 21-23, 2025, from 9AM to 4PM ET. Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases without refund. Auction Company and Seller are not responsible in case of accidents on-premises. Buyers causing damage, harm, creating environmental issues, dumping, destroying or abandoning, refusal, or any other act to cause monetary expense to be incurred to a Seller’s Property or auction site location or property of any type will be held liable for ANY AND ALL damages, cleanup, or repair and may be prosecuted to the fullest extent of the law.
19. Liability: Bidders inspecting or removing enter Property at their own risk. Auction Company and Seller assume no risk for bodily injury or damage to personal property when inspecting or removing the personal property.
20. Agency: The Auction Company and its representatives represent the Seller.
