The property in the sale includes approximately 6½ miles of common boundary with the Jefferson National Forest. With the exception of Tracts 7, 9, 10, 13 and 16, all tracts share at least one boundary with the National Forest. All tracts have one or more creeks, branches or springs, including Little Oregon Creek, Porterfield Creek and Muddy Fork Branch. This sale is being conducted on behalf of the Estate of Robert E. Dunbar. Mr. Dunbar lived on the property and spent a lifetime accumulating this acreage.  He farmed the land and also had a full-time job. Tract 1:  Perfect secluded parcel containing 63.8± acres is located approximately 3 miles from the end of state road maintenance and provides outstanding views. A small portion of this tract is in hayfields. The remainder is hardwood forest and open land. National Forest Boundary:  2,934± linear feet.

Tract 2:  This 74.6± acre parcel features approximately 30 aces of hayfields with the remainder in hardwood forest. There is an old barn which collapsed under the snow of last winter. The tract offers spectacular 360 degree views.  National Forest Boundary:  4,898± linear feet.

Tract 8:  This 78.4± acre parcel has 4,696± linear ft. of common boundary with the Jefferson National Forest and features open land, hardwood forest and breathtaking views. The 2,300 ft. elevation of this tract is the highest in the sale.

Tract 9:  This 33.6± acre tract offers unsurpassed 360 degree views of the surrounding mountains. The timber has been cut from this tract which now has young Virginia pine growth. One ridge has a small cemetery where a Confederate soldier is buried.

Tract 10: Hardwoods and pines are abundant on this 45.1± acre parcel which features a level ridge top with views.

Tract 11:  The 82.9± acres of this parcel feature hardwoods and pastures. It shares a 712± ft. boundary with the Jefferson National Forest.

Tract 12: This 115.7± acre wooded parcel has great hardwood timber and has a 2,833± ft. common boundary with the Jefferson National Forest.

Tract 13: A long level ridge with incredible views is the highlight of this 47.4± acre tract which has hardwoods.

Broker Participation

Any broker actively licensed in the Commonwealth of Virginia whose agent properly registers the successful high bidder will be paid a two percent (2%) commission at settlement by the Seller.  Registration must be on a Woltz & Associates, Inc. Broker Participation Application form and contain the name, address and signature of agent and prospect as well a Broker’s license number and Federal Tax ID number.  The form must be received in the office of Woltz & Associates, Inc. by 12:00 noon on July 23, 2010. If prospect attends preview, agent must attend with prospect. Additionally, agent must attend sale and co-register with prospect on auction day. Basic Terms & Conditions of Auction

  1. REGISTRATION:  Bids will be accepted only from registered bidders. Registration begins at 11:00. Please bring a driver’s license for identification.
  2. TERMS OF SALE:  The real estate in Sale 1 is being sold ABSOLUTE. The real estate in Sales 2 and 3 are being sold subject to seller confirmation. The real in estate in Sale 4 is being sold subject to court confirmation. All property is sold “AS IS, WHERE IS.”  Bidders should perform such independent investigation with respect to the property as they deem necessary or appropriate. SALES 1, 2 and 3 are FINAL SALES. Sale 4 is subject only to court confirmation.
  3. ANNOUNCEMENTS: Announcements day of sale take precedence over all prior communications, verbal and written, concerning this sale.
  4. BIDDING:  SALE 1: Registered bidders may bid on individual tracts of land, any grouping of tracts or on the property as a whole. SALE 2:  This property will be offered separately.   5. BUYER’S PREMIUM:  A Buyer’s Premium will be charged on the real estate. The Buyer’s Premium on real estate is five percent (5%) of the high bid amount. The Buyer’s Premium is added to the high bid amount to determine the sale price.
  6. DEPOSIT:  A deposit on the real estate in the amount of ten percent (10%) of the sale price (high bid plus Buyer’s Premium) will be required on day sale. The deposit is payable by cash, cashier’s check or pre-approved personal check made payable to Woltz & Associates, Inc. Escrow Account. Personal checks will be approved if the Buyer presents, at time of registration, a letter from its bank stating that the Buyer is a customer of the bank and that the account on which the check is drawn is in good standing.
  7. REAL ESTATE CLOSING DATE:  The balance of the purchase price for real estate is due at settlement on or before September 23, 2010.

LEAD-BASED PAINT:  The house on Tract 16 and hunting cabin on Tract 3 in Sale 1 and the hunting cabin in Sale 3 were built prior to 1978 and may contain lead paint.  Inspection may be performed by potential bidders prior to sale day. Applicable lead paint documents and information are available from the Auction Company. Bidders will be provided a lead paint disclosure in the Real Estate Bidder Packet and agree to waive the ten (10) day right to inspect after the sale.
